Obligations of the Insurer

Does an insurance provider have a duty to ensure that you purchase the right type of home insurance policy for your dwelling type? For example, must they make sure you are insured for your pool or farm? Do they need to confirm if you have renters?

 

Answer:

The insurer is not obligated to confirm that you have the right insurance coverage. In most cases, an insurance agent or broker will ask you standard questions in order to help determine the right level of coverage for you, but the ultimate responsibility is yours. However, if you need to make a claim and your assets are not covered under your policy, the insurance company is also not obligated to pay.

 

This is one reason that we at Insurance Guide 101 recommend that you review your insurance regularly. At least once a year, on your policy renewal date, you should be checking over your policy and reviewing the fine print. That way, you can be sure that you have the right insurance coverage that reflects your current situation.
